The Nigeria Customs Service (NCS), Tin Can Island Port Command, has clarified the circumstances surrounding its enforcement actions against the vessel MT NY Maria, following reports it described as misleading and inaccurate.
The Service stated that the vessel was found discharging Premium Motor Spirit (PMS) at the MRS Terminal, also known as Dantata Jetty, without obtaining the required Customs clearance.
In a statement signed by Oscar Ivara,Chief Superintendent of CustomsPublic Relations OfficerFor Customs Area Controllers Tincan Island Port Command said that the Command, officers of the Boarding and Rummaging Unit boarded the vessel on 23 May 2026 after its arrival from the Dangote Refinery to carry out routine documentation and compliance checks.
During the inspection, Customs officers reportedly discovered that the vessel did not possess complete documentation, particularly the mandatory Last Port Clearance from its port of origin.
In line with established procedures, the vessel’s agent was granted a two day period to provide the outstanding document and regularise the vessel’s documentation.Pending compliance, the vessel was lawfully sealed and placed under Customs control in accordance with the provisions of the Nigeria Customs Service Act, 2023.
However, Customs said it later received intelligence on 27 May 2026 indicating that the vessel had commenced discharge operations despite remaining under Customs seal and without obtaining official clearance.Following the report, enforcement officers mobilised to the terminal to verify the situation and enforce compliance with Customs regulations.
The Service disclosed that officers encountered resistance from security personnel stationed at the facility but eventually gained lawful access to the terminal.Upon inspection, officers directed the ship master to immediately halt the unauthorised discharge operation and report to the Enforcement Unit for questioning.Customs clarified that the ship master was not arrested, contrary to some reports, but was only invited to provide statements as part of ongoing investigations.
After the intervention, the vessel was resealed and returned to Customs control pending the conclusion of relevant procedures and investigations.
The Command maintained that its actions were fully backed by the Nigeria Customs Service Act, 2023, particularly provisions governing inspections, documentation verification, Customs control zones and cargo clearance procedures.
The statement noted that the discharge of PMS without Customs authorisation and while the vessel remained under seal constituted a violation of several sections of the Act relating to reporting obligations, goods declaration and unloading procedures.
The Service further emphasised that Customs officers are legally empowered to board vessels, inspect cargoes, enter premises, detain ships and enforce compliance measures within designated Customs controlled areas.While investigations continue, including inquiries into the alleged obstruction of officers during the operation, the NCS reiterated its commitment to facilitating legitimate trade, enforcing compliance with port regulations and safeguarding Nigeria’s economic and national security interests.
